BreathIQ is a public information tool. It does not constitute a medical device (EU Reg. 2017/745), does not issue individual medical recommendations, and in no way replaces a professional medical consultation. In a medical emergency, call your local emergency services immediately.

2 Purpose

These Terms of Use ("Terms") govern access to and use of the BreathIQ website, available at https://breathiq.fr, published by Clément MÉDEAU, private individual, residing in La Rochelle (17000), France.

By accessing the site, the user ("User") accepts these Terms in full. Any person who accesses the site is considered a User.

3 Access to the service

BreathIQ is and will remain freely accessible to everyone, without account creation, registration, subscription or any access barrier, in keeping with the site's public information mission.

The publisher reserves the right to temporarily suspend access for maintenance, without prior notice, and cannot be held liable for such unavailability.

4 Nature of the data

The data displayed on BreathIQ are representative and illustrative, sourced from public institutions (WHO, ECDC, CDC, Eurostat) or constructed for illustrative purposes. They have no official standing and may differ from real-time government data.

Epidemiological data (pathogen outbreaks) are sourced from cited and verifiable official public sources. Users are encouraged to consult those sources directly for any significant decision.

6 User responsibilities

The User agrees to use the site in good faith, in compliance with applicable law, these Terms, and in respect of third-party rights. The User is solely responsible for their use of the information available on the site.

Pursuant to Article 4 of EU Directive 2019/790 on copyright and related rights in the Digital Single Market (transposed in France as Art. L122-5-3 II of the Intellectual Property Code), the publisher expressly and formally exercises its reservation right against any use of BreathIQ content for text and data mining purposes, including for training, fine-tuning or evaluating AI or natural language processing models. This reservation has been in effect since the site first went live.

9 Personal data

The processing of personal data is described in the Privacy Policy. BreathIQ does not collect personal health data and does not carry out any advertising targeting.

BreathIQ may contain links to third-party sites (WHO, CDC, ECDC, etc.). These links are provided for information only. The publisher does not control these sites and accepts no responsibility for their content or availability.

Any inbound link to BreathIQ must clearly indicate the source and must not imply that BreathIQ endorses the linking site.

11 Reporting unlawful content

To report any unlawful content, rights violation or abusive behaviour: contact@breathiq.fr. The publisher commits to handling reports within a reasonable timeframe.

12 Amendments to these Terms

The publisher reserves the right to modify these Terms at any time. Changes take effect upon publication. Continued use of the site after changes constitutes acceptance of the updated Terms. The version date appears at the top of this page.

13 Governing law & jurisdiction

These Terms are governed by French law. In the event of a dispute that cannot be resolved amicably (prior contact required at contact@breathiq.fr), the Tribunal judiciaire de La Rochelle (France) shall have sole jurisdiction.

For consumers residing in the EU, the European online dispute resolution platform is available at: ec.europa.eu/consumers/odr

For users outside the EU, these Terms remain subject to French law. The choice of French jurisdiction does not deprive consumers of the protection afforded by mandatory provisions of the law of their country of habitual residence.
