4 Trademark — BreathIQ
The name « BreathIQ », its logo, and the tagline « Global Respiratory Intelligence » are the exclusive intellectual property of Clément MÉDEAU. Trademark registration is pending at INPI (France), EUIPO (EU), and USPTO (USA) — Nice Classes 35, 42 and 44.
Any unauthorized commercial or non-commercial use of the BreathIQ name or mark that could cause confusion constitutes trademark infringement under Art. L713-2 of the French Intellectual Property Code and Art. 9 of EU Regulation 2017/1001.
5 AI Training Prohibition — Express Opt-Out
The rights holder expressly and formally reserves all rights against any use of BreathIQ content for text and data mining (TDM) for AI training purposes, pursuant to Art. L122-5-3 II of the French Intellectual Property Code (implementing EU Directive 2019/790, Art. 4) and Art. 53(1)(c) of EU Regulation 2024/1689 (AI Act). This opt-out is also materialized via the site's robots.txt file.
